The H.E.B. application to build a superstore at the southeast corner of Hillcrest and LBJ Freeway is waiting a (probably) mid-October City Plan Commission (CPC) hearing for a zoning change. If granted, the zoning change would allow 70’ height on any building, and greatly increase traffic volume and add day and evening retail hours of operation. H.E.B. owns the land, but could decide, upgraded zoning in hand, to sell the property for a tidy profit if they decide their store – usually on 20 acres – cannot fit on the present lot’s 10 acres.
The new law known as Senate Bill 840 (SB 840) is effective September 1. It allows almost any property currently zoned commercial in Dallas and other large cities to also use the property for multifamily development, without applying for a zoning change at the City Plan Commission (CPC), and without consultation with neighborhoods or the City Council. Investors’ discernment about choosing the best places to develop apartment complexes – near public transportation, job, school, shopping – will be key to how this legislation pans out.
